# Guidance on enforcement requests

Overview

This guidance describes the standard processes and requirements of authorized law enforcement agencies and government departments in submitting requests for user data, transaction records or other relevant information to EXBIT.

EXBIT    reserves the right to update the present guidelines from time to time in the light of actual circumstances.

Subject to the applicable laws and regulations, EXBIT is committed to:

Cooperate with legitimate law enforcement requests

While protecting the privacy and data security of users

All enforcement requests (hereinafter referred to as “law enforcement requests”) will:

Review on a case-by-case basis

Treatment is based on:

User Protocol

Privacy statements

Internal compliance policy

Applicable laws and regulations

All enforcement requests must meet the following conditions:

Submitted in English

Send to specified mailbox

The following requests will be inadmissible:

Submitted by non-law enforcement agencies

Not sent to specified mailbox

2 Content requirements of the request

To facilitate the review of your request, please ensure that the submission is complete, including the following information:

(a) Certification of law enforcement qualifications

The following information is required:

Communication using official government mailboxes (with government domain names)

Case or investigation number

Legal legal documents (e.g. court orders, summonses, search warrants, etc.)

Name, contact information and law enforcement documentation of the person requesting the request

Authorisation of documentation certifying the right to make a request on behalf of the relevant law enforcement agency

(b) Information on cases

Please provide a complete background of the case, including but not limited to:

Timeline description of the case

Information on suspects

Victim profile

Transaction Information

To provide:

The wallet address involved

TXID

Amount of transactions and currency

Network of block chains used

Please provide in copyable format (e. g. dock, txt, xls or pdf)

It also states:

How to confirm that the transaction is related to the   EXBIT  Platform

User Information

If available, please provide:

User Name

UID

Registered mobile number

Mailbox Address

ID information

It also needs to be made available in replicable format

Any other information that may assist in understanding the circumstances of the case.

(c) Content of requests and specific measures

Please specify the content of the request in the message theme, for example:

Data Call

Accounts freeze

Treatment of assets

Information disclosure requests

It is clear that:

Target users (e.g. user name, mailbox, wallet address, etc.)

Type of data requested (e.g. registration information, transaction records, IP logs, etc.)

Time frame of request

Other measures

If necessary:

Freezing of accounts

Seizure of assets

Please provide:

Relevant legal documents (court orders, etc.)

Description of the duration of the freeze

Without an indication of the duration of the freeze,   EXBIT   may by default freeze  30 days.

(d) Form requirements for requests

The following shall be inadmissible:

Requests for non-English (certification of English translation required)

Data not copyable format

Unsigned or unsealed

Non-acceptance of electronic signature or electronic seal

All compliance enforcement requests should be sent to:

Subject to the requirements of article 2:

General request processing time:  15-20 working days

EXBIT Reservations:

Request for additional information

Extension of processing time

Complex cases or large-scale requests may require longer processing.

2\. Urgent requests

In case of an emergency (where there is an immediate risk), law enforcement agencies may submit an urgent request.

Requests:

Email title indicates  “Emergency”

Send to specified mailbox

EXBIT  will give priority to this category of requests.

Requests submitted by non-law enforcement agencies (such as individuals or lawyers):

Failure to do so should result in contact with local law enforcement agencies.

3\. User privacy protection

EXBIT  gives high priority to user privacy and discloses information only if:

Legally explicit requirements

Legal enforcement requests

EXBIT will comply with all laws and regulations relating to data protection and privacy.

International law enforcement requests

For cross-border enforcement requests, EXBIT    may require:

Mutual Legal Assistance Agreements (MLAT)

International cooperation documents

All international requests are subject to:

Local law

International treaties

4\. User announcement

Where confidentiality is not expressly required by law:

EX Possible notification to relevant users prior to data disclosure

If the law enforcement agencies require confidentiality, they need to provide:

Clear legal basis

Statements of exemption

The content of these guidelines does not constitute:

Automatic consent to any enforcement request

Recognition of any jurisdiction

All requests will be independently assessed on a case-by-case basis.
